1. Acceptance of Terms

By accessing or using K Spider AI Tool (www.kspiderai.in), registering an account, or purchasing any plan, you unconditionally agree to these Terms & Conditions. These are governed by the Information Technology Act, 2000, Consumer Protection Act, 2019, and all applicable Indian laws. If you disagree with any part, please discontinue use immediately.

2. Service Description

K Spider AI Tool is a digital platform offering AI-powered tools across categories including marketing, health, education, finance, legal, and social media. Tools are available in two access modes: Free (available to all registered users) and Premium/Paid (requires a valid paid plan). All tools are provided as digital software services and may be updated, modified, or discontinued at any time with reasonable notice.

3. Paid Plans — Site-Wide & Per-Tool

3a. Site-Wide Plans: A Site-Wide Premium or Franchise plan grants access to all tools marked Premium/Franchise on the platform for the purchased duration (1 month, 3 months, 6 months, or 1 year). Pricing is set by the administrator and is displayed at the time of purchase.

3b. Per-Tool Plans: A Per-Tool plan grants access exclusively to one specific tool for the chosen duration. It does not grant access to any other premium tool. Each tool must be purchased separately. Per-tool pricing is set individually by the administrator.

3c. Payment & Activation: All payments are processed via UPI (manual). Access is activated within 24 hours of payment verification and admin approval. We reserve the right to change pricing with 7 days' prior notice.

4. User Registration

You must register with a valid email address and mobile number. You are responsible for maintaining the confidentiality of your account. Each email address may only be registered once. Providing false information during registration is a violation of these Terms and may result in immediate account suspension without refund.

5. Prohibited Use

You agree NOT to: (a) use tools for spam, phishing, bulk illegal messaging, or any activity prohibited under Indian law; (b) attempt to reverse-engineer, decompile, or copy the platform or its tools; (c) resell, sublicense, or commercially redistribute tool access without explicit written permission; (d) use automated bots or scrapers to access the platform; (e) harass, abuse, or harm other users; (f) upload malicious content or attempt to breach platform security; (g) submit fraudulent payment information or UTR/transaction IDs.

6. Intellectual Property

All content, source code, branding, tool interfaces, designs, and materials on K Spider AI Tool are the exclusive intellectual property of K Spider for Kreation (Gaurang Raval & Khush Raval). Unauthorized reproduction, distribution, or commercial use is strictly prohibited under the Copyright Act, 1957 and the Trade Marks Act, 1999.

7. AI Output Disclaimer

All AI-generated outputs — including health suggestions, legal drafts, business advice, financial estimates, and medical information — are provided for informational and assistive purposes only. They do not constitute professional medical, legal, financial, or any other certified advice. Always consult a qualified professional. K Spider for Kreation expressly disclaims all liability for decisions made based on AI-generated content.

8. Account Suspension & Termination

K Spider for Kreation reserves the right to suspend or permanently ban any account that violates these Terms, without prior notice and without any obligation to issue a refund. Grounds include: fraudulent payments, platform abuse, ToS violations, and chargebacks.

9. Limitation of Liability

To the maximum extent permitted by law, K Spider for Kreation's total liability to you shall not exceed the amount you paid for the applicable plan in the preceding 12 months. We are not liable for any indirect, incidental, consequential, or punitive damages arising from use of this platform.

10. Modifications to Terms

We may update these Terms at any time. Continued use of the platform after changes constitutes your acceptance. Significant changes will be communicated via email or on-platform announcement with at least 7 days' notice.

11. Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of the Republic of India. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

Registration data: Full name, email address, mobile number, city/state.

Payment data: UPI Transaction Reference (UTR), Order ID, plan selected, amount paid. We do not store UPI IDs, bank account numbers, or card details.

Usage data: Tools accessed, session timestamps, browser type, approximate location (city-level via IP) — for analytics and security only.

Communication data: Messages and support requests you send us.

3. How We Use Your Information

Your data is used exclusively to: (a) create and manage your account; (b) activate and manage your paid plan access; (c) send account-related notifications (plan expiry, payment confirmation); (d) provide customer support; (e) improve platform performance; (f) comply with legal obligations. We do not use your data for unsolicited marketing without your explicit consent.

4. Data Storage & Security

All user data is stored on Google Firebase Firestore — a secure, encrypted, cloud-based database compliant with ISO 27001, SOC 1/2/3 standards. All data in transit is protected by SSL/TLS encryption. Admin access is strictly restricted.

5. Data Sharing

We do not sell, rent, or trade your personal data. Data is shared only with: (a) Google Firebase for secure storage; (b) EmailJS for transactional emails only; (c) Law enforcement if legally required under Indian law. No advertising networks receive your personal data.

6. Cookies

We use essential cookies and browser localStorage to maintain your login session. We do not use third-party tracking or advertising cookies. Google AdSense (if displayed) may set its own cookies per Google's Privacy Policy.

7. Your Rights (DPDPA 2023)

Under the Digital Personal Data Protection Act, 2023 you have the right to: (a) Access your personal data; (b) Correction of inaccurate data; (c) Deletion of your account and all associated data; (d) Withdraw Consent at any time. 8. Data Retention

We retain account data for as long as your account is active. Upon deletion request, all personal data is deleted within 30 days, except payment records retained for 7 years as required by the Income Tax Act, 1961.

9. Children's Privacy

10. Policy Updates

We may update this Privacy Policy periodically. Material changes will be communicated via email or on-platform notice with at least 7 days' advance notice.

1. Scope of This Policy

This Refund Policy applies to all paid plans offered on K Spider AI Tool (www.kspiderai.in), including: Site-Wide Premium Plan, Franchise Plan, and Per-Tool Individual Plans. Free registrations are not covered. This policy complies with the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020.

2. 7-Day Refund Window

You are eligible to request a refund within 7 calendar days from the date your access was activated by the admin (not from the date of payment submission). If your refund request is approved, you will receive 75% of the amount paid. The remaining 25% is non-refundable and covers: UPI transaction processing fees, admin verification costs, and digital service delivery charges already incurred.

3. Per-Tool Plan Refunds

Per-Tool Plans (plans purchased for access to a single specific tool) are equally covered under this policy. Upon approval of a refund for a Per-Tool Plan, access to that tool will be immediately revoked. The same 75% refund / 7-day window rule applies.

4. After 7 Days — No Refund

Once 7 calendar days have passed from your access activation date, no refund will be issued under any circumstances, regardless of usage or reason.

5. Refund Denial Conditions

A refund will be denied if any of the following apply: (a) request is made after 7 calendar days from access activation; (b) you have used the tool or platform features extensively (more than 15 active sessions); (c) your account has been suspended or banned for Terms of Service violations; (d) the refund request is deemed fraudulent or the original payment UTR was invalid; (e) your account has previously received a refund from K Spider for Kreation; (f) a chargeback or payment dispute has been initiated through your bank.

6. How to Request a Refund

Email us at kspider221206@gmail.com within 7 days of access activation. Subject line: "Refund Request — [Plan Name / Tool Name]". Include: your registered email address, the Order ID, the UPI Transaction Reference (UTR), and reason for your request. Approved refunds will be credited to your original UPI account within 5–7 business days.

7. Digital Product Acknowledgement

By completing a purchase on K Spider AI Tool, you acknowledge that: (a) you are purchasing a digital software service; (b) access is granted immediately upon admin approval; (c) the digital nature of the product means full access is provided upon activation. This refund policy is consistent with Section 47 of the Consumer Protection Act, 2019 applicable to e-commerce entities.

K Spider for Kreation reserves the right to update this Refund Policy at any time. Changes will be communicated via email or on-platform notice with at least 7 days' advance notice.
